Pathoragy — Terms of Service

These Terms of Service ("Terms") are an agreement between you and truake LLC ("truake", "we", "us"), the operator of the Pathoragy iOS app and the truake.com/pathoragy website (together, the "Service"). Please read them — they are written in plain English on purpose.
1. Acceptance of terms
By downloading, installing, or using Pathoragy, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service. You must be at least 13 years old to use Pathoragy; if you are under the age of majority where you live, you need a parent or guardian's permission.
Your use of Pathoragy is also subject to Apple's Media Services Terms and Conditions. Where these Terms and Apple's terms both apply to your App Store purchase, Apple's terms govern that purchase.
2. License
Subject to these Terms, truake grants you a limited, personal, non-exclusive, non-transferable, non-commercial, revocable license to download and use one copy of Pathoragy on Apple devices you own or control, for your own personal, reflective use.
You may not: resell, sublicense, rent, or commercially exploit the app; copy, modify, reverse-engineer, decompile, or create derivative works from it (except to the limited extent that applicable law overrides this restriction); or remove any proprietary notices.
3. Your responsibilities
When you use Pathoragy, you agree to:
- Use your own AI access responsibly. The AI features run on the provider and API key you configure. Do not use them to abuse, overload, or violate the terms of any AI endpoint, and do not use Pathoragy to send unlawful, infringing, or harmful content to a provider.
- Keep verification honest. The photo-verification and "verified" badges are meant to reflect something you actually did. Do not submit false, staged, or misleading evidence to obtain a verified badge. The badges are a personal-integrity feature, not a reward to be gamed.
- Comply with Apple's terms. Follow Apple's Media Services Terms and any applicable App Store rules for your purchases and use.
- Keep your credentials secure. You are responsible for the AI API keys you store in the app and for activity conducted with them.
- Not misuse the Service — no attempts to breach security, disrupt the app, or use it in violation of applicable law.
4. Subscriptions
Pathoragy offers an optional auto-renewable subscription, Pathoragy Pro:
- Pathoragy Pro Monthly — US$4.99 / month
- Pathoragy Pro Annual — US$34.99 / year (saves about 42%)
The terms below apply to all subscriptions:
- Billing. Subscriptions are auto-renewable and are billed through your Apple ID. Payment is charged at confirmation of purchase.
- Renewal. Your subscription renews automatically for the same period at the then-current price unless you cancel it at least 24 hours before the end of the current period. Apple charges your account for renewal within 24 hours prior to the end of the period.
- Cancellation. You can cancel any time in Settings → Apple ID → Subscriptions on your device. Cancellation takes effect at the end of the current paid period; you keep Pro access until then.
- Free trial (if offered). If a subscription includes a free trial, any unused portion is forfeited when you purchase a subscription, and the trial converts to a paid subscription at the price shown unless you cancel at least 24 hours before the trial ends. The conversion date is shown to you before you start.
- Refunds. Purchases are handled by Apple. We do not separately process refunds; refund requests are subject to Apple's standard refund process (reportaproblem.apple.com).
- Free tier. The free tier (9 Lighthouse figures free forever, one truncated AI reflection per week, and the full Logbook and Boat features) remains available whether or not you subscribe.
We may change subscription pricing or features for the future; any change applies prospectively and, where required, with notice. Existing paid periods are not affected.
5. Intellectual property
The Service — including the Pathoragy name and logo, the Value Boat / Lighthouse / Waypoint / Vitality designs, the app's text, graphics, and software — is owned by truake and protected by intellectual-property laws. "Pathoragy" and related marks are trademarks of truake. Except for the license in §2, no rights are granted to you in our intellectual property.
Your content is yours. The Logbook entries, notes, evidence, scores, and Boat customizations you create remain your property. Because they are stored locally on your device, we do not claim any license to them and, in the ordinary course, never even receive them.
6. The Value Boat book
Pathoragy is the companion app to the book The Value Boat. Pathoragy and The Value Boat may reference each other in plain text (titles, concepts, and quotations consistent with fair use), and that is permitted. You may not:
- claim that The Value Boat or Pathoragy was authored, endorsed, or produced by anyone other than truake (and the credited author); or
- reproduce substantial portions of the book's text through the app or otherwise without permission.
7. AI-generated content disclaimer
Pathoragy's reflections and photo verifications are produced by third-party AI models that you connect with your own key. This output is generated text/inference and may be inaccurate, incomplete, or unsuitable for your situation.
- truake does not guarantee and is not responsible for the accuracy, reliability, safety, or fitness for any purpose of AI-generated content.
- AI output does not constitute medical, psychological, legal, financial, or other professional advice, and is not a substitute for a qualified professional. Do not rely on it for decisions that require professional judgment. If you are in distress or facing an emergency, contact a qualified professional or your local emergency services.
- You are responsible for how you interpret and act on AI output, and for the provider whose model produced it.
8. Termination
You may stop using the Service at any time by deleting the app. We may suspend or terminate your access to the Service (or specific features) if you materially breach these Terms or use the Service unlawfully. Sections that by their nature should survive termination — including intellectual property (§5), disclaimers (§7, §9), limitation of liability (§10), and governing law (§11) — survive.
9. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your expectations. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
10. Limitation of liability
To the maximum extent permitted by law, truake and Rock Lam will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service — including any reliance on AI-generated content. To the extent we are found liable despite the above, our total aggregate liability is limited to the greater of the amount you paid us for the Service in the 12 months before the claim or US$50. Some jurisdictions do not allow these limitations, so they apply only to the maximum extent permitted by law.
11. Governing law
These Terms are governed by the laws of Hong Kong, without regard to its conflict-of-law rules.
12. Dispute resolution
If a dispute arises, please first contact us at rocklam@truake.com — most issues can be resolved quickly that way. Any dispute that cannot be resolved informally will be submitted to the courts of Hong Kong, and you and truake agree to submit to the personal jurisdiction of those courts. Nothing in these Terms affects any mandatory consumer rights you have under the law of your country of residence.
